EU may register truck and bus tires imported from China

The applicant of the anti-dumping allegation against truck and bus tires imported by EU from China has proposed to register all the tire imports related to the allegation.

According to local rules, EU can impose anti-dumping tax on products imported up to 90 days before temporary anti-dumping measures are taken.

According to people familiar with the case, the European Commission is unlikely to make preliminary ruling on the case within the upcoming 90 days.

However, if EU applies import registration, EC will be able to tax anti-dumping rates retroactively from the date of import registration.

Currently, Chinese lawyers are preparing for the defense materials in response to applicant’s claim.

EC decided to take the U.S. as the surrogate country in the anti-dumping investigation, and Turkey, Japan and Republic of Korea are the candidate surrogate countries.

Chinese lawyers claimed that as the 15th term of the Protocol on China’s Access to the WTO has expired, EC shouldn’t apply surrogate country in the case.

Moreover, the US and Japan are definitely not suitable surrogate countries; Thailand is a suitable choice; besides Thailand, Turkey, Egypt and Brazil can be considered as suitable candidate surrogate countries.
